Did you read about the allegations that Florence Hartmann, the International Criminal Tribunal for the former Yugoslavia official spokesperson and Carla de Ponte’s chief adviser, has made in her new book, “Peace and Punishment”? Well, unless you live in Bosnia & Herzegovina, Croatia or perhaps France, the chances are that you heard little. It has not been met with much more than another Paris Hilton, or is Britney Spears exclusive. It should be no surprise. This is viewed as more history rather than anything that will bring about political, legal or even personal consequences. Are we that boring or just inept at protecting our rights and interests?
Well Established Allegations, But This Time from Within
The allegations are not particularly new. There has been evidence provided of no-arrest deals for Karadzic and Mladic by several prominent sources who might know, including then Foreign Minister Muhamed Sacirbey of BiH. Also, there has been Karadzic’s immediate family and former assistants. What is newsworthy is that this time the allegations come from within the very inner circle of the ICTY, the Prosecutor’s office. In the past, the diplomacy of the leading western democracies has tried to discredit such allegations, the sources or both. This time though, it comes from in effect one of their own and with the apparent detail suitable for a courtroom.
Deals Spanning Two Centuries and 2 US Administrations
Ms. Hartmann provides evidence of specific moments when the leadership of the new world order and the free world opted to shield war criminals born out of the old sphere of totalitarianism and responsible for some of the worst acts in Europe in the last half century. According to this former ICTY high official, Bill Clinton, Tony Blair, Helmut Kohl and Jacques Chirac agreed not to arrest Karadzic and Mladic in order not to offend Boris Yeltsin’s Moscow. This was 1997 when Karadzic and Mladic were easy picking, as they still lived and moved openly.
The betrayal of judicial accountability and legality occurred in the new millennium as well, under the leadership of the new administration of George W. Busch when US officials prevented an arrest operation on several occasions.
Ms. Hartmann alleges in interviews surrounding the launch of her book that the non-arrests were not so much a decision made at the moment, but a long standing policy, one that needed to be kept secret and actively defended against those that would challenge it or even expose it. Karadzic was ferried between destinations, although it is not clear whether western and Russian forces in BiH provided the logistics or just greased the way.
Ms. Hartmann does raise the question: was there a deal not to arrest at least between Karadzic and Richard Holbrooke? She says that she cannot definitively answer that specific allegation simply because she has not seen the absolute proof. However, she says that she would not doubt the possibility of this bargain.
Srebrenica was Foreknown

Maybe most shockingly, Ms. Hartmann asserts that the leadership of the new world order had irrefutable knowledge of the pending assault upon Srebrenica in 1995, but opted not to act. She proposes the motive: complicity to satisfy Milosevic’s territorial demands. Otherwise, how did the democratic powers allow Srebrenica to remain in Serbian hands during the negotiations in Dayton, unless that was the desired result?
Milosevic was Shielded as Not to “Sing”
Not so surprisingly, Hartmann also reveals that the big powers took measures to protect Milosevic from the ICTY’s prosecution. Not only was evidence kept hidden, but the work of the Tribunal was obstructed. Milosevic’s death, that is the cause of it, is not raised by Hartmann directly, However, she leaves no doubt that Milosevic was only about to begin his singing. Milosevic, as well as Karadzic and Mladic had too much information to compromise the leadership of the globe’s big powers.

The real question is will anyone, who made the deals and shielded the war criminals from justice, answer before a court for what constitute violations of international humanitarian law as well as betrayal of the United Nations, NATO, the Dayton Accords, not to mention the states affected by the mandate of the ICTY, including BiH and Croatia? At least, will there be an investigation by the United Nations, the US Congress, other relevant national bodies or the ICTY itself?
What’s your best guess? If history is to tell, then I’m afraid I already know the answer.
And yet, if the political, judicial, social and spiritual leadership, particularly of BiH and Croatia, does not demand an investigation, then they have accepted our designation as the zoo animals. So far, while the culpability of some of the zoo keepers is self-evident, even admitted, there is an assumption that the ICTY is only for the Balkan inhabitants.
Croatia may have gotten rid of the designation “Balkan” in almost all forms except before the ICTY in terms of the distinction made between its citizens, officials, journalists and those of the rest of the Euro-Atlantic family. Has any western official even been held in contempt of court or publicly reprimanded for obstructing the work of the ICTY?
Ms. Hartmann notes herself that the Hague Tribunal was never really intended by the Security Council powers to function as an independent court. These powers saw it as a tool of political control, once they could no longer resist its realization. Ambassador Sacirbey has confirmed that the Tribunal was initially only meant to be a promise of justice to come in lieu of concrete preventive action today to confront genocide and war crimes. It is strange that even Ms. Hartmann does not seem to consider the question of who should answer for the subversion of legality to which she gives testimony within the very institution for which she worked. I don’t think that Ms. Hartmann suffers from the same inferiority complex as much of the leadership in the region, but she seems to take our chronic suffering as a constant.
Why not? We have not yet asked the right questions of them regarding their acquiescence or complicity. Croatia has been threatened and sanctioned. BiH has suffered the same, but worse. It is now colored as a whole with the designation of unfit for EU and NATO membership, and for the very betrayal committed by those who stand as bouncers at the door. The High Representative sits in judgment in Sarajevo, but how can we trust his independence or judgment in view of who signs his checks.
Belgrade and Banja Luka just laugh as the confident blackmailers.

Russia and U.S. “blocked Karadzic arrest” – book
Sept 7 (Reuters) – Russia blocked the arrest of Bosnian Serb war crimes fugitive Radovan Karadzic in 1997 and the United States and Britain persuaded France not to insist on it, according to a new book by a top war crimes official.
Florence Hartmann, former spokeswoman at the Hague war crimes tribunal for Yugoslavia, recounts how President Bill Clinton, supported by Britain’s Tony Blair and Germany’s Helmut Kohl, persuaded France’s Jacques Chirac not to push the issue.
Hartmann says they met in the garden of the Elysee Palace in Paris in May 1997, 17 months after the peace accords which ended the 1992-95 Bosnia war.
Chirac was still fuming over the capture of two French pilots who were shot down and held hostage by Bosnian Serb forces in 1995, and wanted to expunge the affront. “Bill Clinton stressed that the operation could not be undertaken without informing the Russians. Chirac was opposed because Moscow had firmly opposed the arrest of Karadzic and would have immediately tipped him off,” Hartmann writes.
Karadzic, who was “president” of Bosnia’s rebel Serb Republic during the war, is still at large 11 years later, indicted on two counts of genocide for the slaughter of Bosnian Muslims and Croats.
“Clinton insisted, supported by Blair. Chirac ended up by conceding the issue,” writes Hartmann in “Peace and Punishment”, excerpted by the Paris daily Le Monde. “Karadzic was not arrested because of Russian opposition,” she quotes Chirac as telling Hague prosecutor Carla Del Ponte.
“Boris Yeltsin told me: Karadzic knows too much about (then Yugoslav president Slobodan) Milosevic. He warned me he would send a plane to get him out of Bosnia if necessary, but he would never permit the arrest of Karadzic,” Chirac is quoted as saying.
In November 1997, as NATO-patrolled Bosnia was about to hold a post-war election, a Russian plane whisked Karadzic off to Belarus for several months to keep him out of danger.
But the book describes how leaders of the major powers each blamed the other for failure to arrest the man held responsible for Europe’s worst atrocities since World War II.
In 2000, Del Ponte was told by Chirac that the United States had prevented the arrest of Karadzic in Bosnia, hardening his belief that Washington had a secret deal to let him go free.
Former NATO commander Wesley Clark, however, asserted to Del Ponte that it was France which had made a secret no-arrest deal with Karadzic and his wartime commander General Ratko Mladic, in order to obtain the release of the two French aviators. In 2004, Del Ponte learned of the imminent arrest of Karadzic in Bosnia and Serbia’s appeal to France to arrange his transfer to The Hague.
“The Americans intervened with the Serbs to stop the operation. The information was immediately transmitted to the (NATO force) commander in Bosnia and a few hours later a helicopter flew over the area, thereby alerting Karadzic.”
Del Ponte says Mladic is hiding in Serbia. Srebrenica, Milosevic et le génocide
Le travail d’obstruction des Occidentaux sur les tueries de Srebrenica, en Bosnie, en juillet 1995, n’a pas concerné que la fuite de Radovan Karadzic. Il inclut également le contrôle exercé sur le procčs de l’ex-président serbe Slobodan Milosevic au Tribunal pénal international pour l’ex-Yougoslavie (TPIY). “Les Occidentaux ne souhaitent pas que le Tribunal s’intéresse de trop prčs ŕ l’orchestrateur de la politique de nettoyage ethnique qui a ravagé l’ex-Yougoslavie et se gardent bien de lui livrer les éléments de preuve en leur possession”, écrit Florence Hartmann dans Paix et châtiment. Elle souligne “l’étonnante coďncidence des résistances au sein du TPIY et des blocages des grandes puissances”.
Durant les quatre années du procčs Milosevic, jusqu’ŕ son décčs en prison en 2006, Geoffrey Nice, le substitut de la procureure Carla Del Ponte, a mal plaidé l’affaire, estime Florence Hartmann. Il souhaitait, faute de preuves, retirer les charges de génocide et de crime contre l’humanité portées contre l’ex-président serbe pour les crimes commis ŕ Srebrenica et durant le sičge de Sarajevo. Or ces drames “étaient les deux phases paroxysmiques du projet criminel serbe en Bosnie. Elles étaient aussi les deux plus flagrants symboles de l’incurie des gouvernements occidentaux”, écrit l’ancien porte-parole de Mme Del Ponte.
M. Nice s’appuyait sur les conclusions des analystes militaires du parquet. Placés par les Américains et les Britanniques, ces analystes ont, selon Florence Hartmann, “volontairement et systématiquement dissimulé la responsabilité directe de Milosevic dans les crimes en Bosnie et notamment ŕ Srebrenica”. “Nombre de témoins occidentaux n’ont pas été autorisés par leur gouvernement ŕ témoigner au procčs Milosevic (…). Les principaux négociateurs qui ont rencontré des dizaines de fois Milosevic restent ainsi les grands absents du procčs”, poursuit-elle.
Les pičces-clés du dossier sont obtenues par Mme Del Ponte de haute lutte avec Belgrade. Et “trois câbles cryptés en date du 11 juillet 1995 montrent que Milosevic a été informé de la situation ŕ Srebrenica et qu’il pouvait prévoir les intentions génocidaires de ses alliés”, estime Florence Hartmann. L’un des câbles précise que “l’armée bosno-serbe va vraisemblablement séparer les hommes en âge de se battre du reste de la population, et les troupes (de l’ONU) ne pourront pas y faire grand-chose”.
Pour l’auteur, “les réunions du CSD (Conseil supręme de défense serbe) aprčs les massacres de Srebrenica indiquent que Milosevic approuve les atrocités”. “Il ne condamne ŕ aucun moment les tueries. Au contraire, il se félicite du succčs militaire de Mladic et du peu de pertes humaines qu’il a subies, et admet avoir eu des contacts avec Mladic pendant l’attaque contre Srebrenica.”

– Enquęte – La capture entravée de Karadzic
En instituant, en 1993, le Tribunal pénal international pour l’ex-Yougoslavie (TPIY), les grandes puissances s’engageaient ŕ faire reculer la barbarie grâce ŕ l’action de la justice internationale. Les Balkans étaient alors ŕ feu et ŕ sang. On comparait le tribunal de La Haye ŕ celui de Nuremberg. Quatorze ans plus tard, ces bonnes intentions sont assombries par l’attitude équivoque des diplomaties occidentales, qui ont souvent fait obstruction aux enquętes du TPIY. Présente au cSur du parquet pendant six ans, Florence Hartmann, ancien porte-parole de la procureure général, Carla Del Ponte, révčle, dans Paix et Châtiment (Flammarion) ŕ paraître le 10 septembre, les rouages de cette mécanique et décrit les coups tordus entre “alliés”.
Les dessous de la fuite de Radovan Karadzic, l’ancien chef politique des Serbes de Bosnie durant la guerre (1992-1995), illustrent le propos. Ils expliquent pourquoi l’homme court toujours, onze ans aprčs son inculpation pour génocide par le TPIY.
Un jour de mai 1997, une scčne de ce théâtre d’ombres entre grandes puissances se joue ainsi ŕ Paris, dans les jardins de l’Elysée. Le président français, Jacques Chirac, son homologue américain, Bill Clinton, le chancelier allemand, Helmut Kohl, et le premier ministre britannique, Tony Blair, “se retrouvent en aparté”. Dix-sept mois aprčs la signature de l’accord de paix de Dayton qui fit taire les armes en Bosnie, Paris n’a toujours pas digéré la prise en otage de deux de ses pilotes par les Serbes, peu avant la fin de la guerre. M. Chirac entend laver cet affront. Il veut Radovan Karadzic.
“Bill Clinton souligne que l’opération ne peut pas ętre lancée sans en informer les Russes. Chirac est contre car Moscou s’est, jusque-lŕ, fermement opposé ŕ toute arrestation de Karadzic et s’empressera d’alerter le fugitif. Soutenu par Tony Blair, Clinton insiste. Chirac finit par céder”, raconte Florence Hartmann. Mal lui en prit. M. Chirac confiera ultérieurement ŕ Mme Del Ponte : “Karadzic n’a pas été arręté en raison de l’opposition des Russes. (…) Boris Eltsine m’a dit : ‘Karadzic sait trop de choses sur Milosevic (l’ex-président serbe)’, et il m’a averti qu’il enverrait un avion pour l’extraire de Bosnie si nécessaire, mais qu’il ne laisserait jamais Karadzic ętre arręté”, rapporte l’auteur. De fait, la veille des élections en Bosnie, en novembre 1997, “Karadzic s’envole, via la Serbie-Monténégro (…), pour la Biélorussie, dans un avion militaire affrété par Boris Eltsine”, écrit Florence Hartmann. L’escale biélorusse dure quelques mois, puis Karadzic retourne en Bosnie.
Une autre tentative avorte début 2000. L’homme — dont la tęte est mise ŕ prix 5 millions de dollars par les Américains — est repéré dans le secteur militaire français de Bosnie. Carla Del Ponte est reçue ŕ l’Elysée. “Chirac accuse sans détour les Américains d’empęcher l’arrestation. Pour preuve, ‘la France, dit-il, a encouragé dans le passé les Américains ŕ intervenir, mais ils n’ont pas bougé’. Chirac concčde avoir la conviction qu’un accord a été conclu au moment de Dayton mais ne pas en détenir la preuve formelle”, lit-on dans l’ouvrage.
Mme Del Ponte pose alors la question au général américain Wesley Clark, chef des forces de l’OTAN. Celui-ci accuse ŕ son tour M. Chirac “d’avoir pactisé” avec Karadzic et le chef militaire bosno-serbe Ratko Mladic, afin d’obtenir la libération des pilotes français.
En douze ans de cavale, Florence Hartmann n’identifie que trois véritables opérations. Mais toutes, en réalité, ne sont destinées qu’ŕ sommer Karadzic de stopper ses activités politiques. Aucun des pays en mesure de le faire ne paraît souhaiter l’arręter. Mais tous mčneront des négociations avec l’accusé. “Chaque grande puissance a ses propres dettes, en sus de celles qu’elles partagent toutes ensemble, [et] la France n’a jamais souhaité lever le doute sur les circonstances de la libération de ses pilotes”, souligne Florence Hartmann. Sur ce dernier point, M. Chirac dément formellement. En juin 2003, lors d’une rencontre avec Mme Del Ponte ŕ l’Elysée, le président français affirme que la France a “exigé sans conditions la libération des pilotes”.
La protection offerte, de facto, ŕ Karadzic est pourtant bien utile. Elle masque notamment des responsabilités occidentales dans le drame de Srebrenica : 7 000 Bosniaques musulmans exécutés par les hommes de Ratko Mladic en trois jours de juillet 1995, sous le regard impuissant des casques bleus de l’ONU. Sans doute cela permet-il également de préserver la paix de Dayton, concoctée par les Occidentaux, mais qui a figé sur les cartes des territoires conquis par la force.
Cette protection implicite a pris différentes formes. Les Occidentaux ont ainsi refusé de fournir pičces et témoignages pour le procčs ŕ La Haye contre l’ancien président serbe Slobodan Milosevic, favorisant la cavale tranquille de Karadzic. Ce ne sont pourtant pas les éléments qui manquent. Début 1995, écrit Florence Hartmann, la CIA a équipé “deux bases secrčtes en Croatie, d’oů peuvent ętre interceptées les communications téléphoniques sur une grande partie du territoire ex-yougoslave”. “Depuis janvier 2002, Carla Del Ponte sollicite les Américains pour obtenir les écoutes en leur possession. (…) Mais Washington reste de marbre et les requętes [du TPIY] sont laissées en souffrance”, constate l’auteur. Męme échec lorsque la procureure se tourne vers les Français.
Or, sans la collaboration occidentale, l’action du TPIY est bancale. Ce qui est vrai pour la collecte de certaines pičces ŕ conviction l’est encore d’avantage pour l’arrestation d’un fugitif. Car les enquęteurs du TPIY ne disposent pas de ce pouvoir de police détenu, en revanche, par les forces étrangčres ou locales basées en Bosnie. Leur passivité fait enrager Mme Del Ponte. Tout particuličrement lorsqu’elle localise trčs précisément Karadzic. Comme en 2001, lorsque le TPIY négocie avec lui sa reddition. A cette époque, il exige, en échange, 300 000 deutschemarks et une mise en résidence surveillée, car il craint d’ętre exécuté par les hommes de Milosevic. L’opération capote. Il ne fait pas confiance ŕ la protection de l’OTAN et reprend sa cavale.
Ainsi entravée, Mme Del Ponte décide, en 2002, de constituer sa propre cellule de recherche et rassemble 150 000 euros afin de “ne plus dépendre des Occidentaux”. Mais nouvelle déconvenue, en 2004. Elle avait appris “la mise sous surveillance policičre de Karadzic et son arrestation imminente (…)”. “Les Serbes ont fait appel ŕ la France pour assurer le transfert jusqu’ŕ La Haye. Au grand dam des Américains, qui interviennent auprčs des Serbes pour suspendre l’opération”, écrit l’auteur. Quand les limiers du TPIY retrouvent la trace de Karadzic ŕ la frontičre serbe, “l’information est immédiatement transmise au commandant de la SFOR (forces de l’OTAN en Bosnie) ŕ Sarajevo”. “Quelques heures plus tard, un hélicoptčre survole la zone, alertant ainsi Karadzic.” Nouvelle fuite.
Le pičge se referme aussi lorsque Carla Del Ponte choisit de travailler avec la police locale durant l’été 2005. Cette fois-ci, “elle apprend qu’un agent de la CIA est venu (…) demander aux agents bosno-serbes de suspendre la filature de la famille Karadzic, prétextant qu’il s’agissait d’un ordre de La Haye” ! “Prises en faute, les autorités américaines regrettent devant la procureure du TPIY une “erreur de communication”, sans plus d’explication.”
Ulcérée, Mme Del Ponte a bien menacé, la męme année, de tout révéler au Conseil de sécurité de l’ONU. “Les ambassadeurs défilent dans le bureau de Del Ponte, ils se disent choqués” par la menace, note Florence Hartmann. L’OTAN réussit finalement ŕ amadouer la procureure, qui laisse tomber sa menace. En 2007, Radovan Karadzic court toujours. Le Conseil de sécurité, lui, a programmé pour 2010 la fermeture du TPIY.

Šta je glavni sadržaj Vaše knjige?
– Rad Haškog tribunala ometale su velike sile. SAD, Velika Britanija i Francuska nisu poštivali nezavisnost suda i željele su da Tribunal bude instrument u njihovim rukama. Nekad su ciljevi međunarodne pravde i međunarodne politike bili isti, nekada ne. No, mnogo je primjera gdje je Tribunal mogao mnogo bolje raditi da nije bilo smetnji velikih sila.
Koji su to primjeri?
– Pozitivan je – naprimjer – hapšenje Slobodana Miloševića. To je ogroman uspjeh pravde i politike. Po prvi put šef države našao se pred sudom suočen s teškim optužbama. Međunarodna pravda uspjela je osigurati da se takvo nešto desi po prvi put u historiji! Politika je tu uspjela ispoštovati zahtjeve pravde kroz vlast u Srbiji i lik premijera Zorana đinđića. Velike sile u početku nisu žurile da se Milošević uhapsi. No, ipak se to desilo. Sličnih primjera ima još i ja ih u knjizi navodim.
A negativni?
– Naravno, Karadžić i Mladić. Isto tako, bilo je dosta opstrukcija u predmetu protiv Miloševića. Primjera ima još puno. U Miloševićevom predmetu ispostavilo se da velike sile – koje nisu bile protiv njegovog suđenja – u početku nisu željele da on uopće bude optužen. Mi smo bili bez njihove podrške u nastojanjima da se dokazni materijal protiv njega u Srbiji prikupi. Mi smo u BiH dobivali dosta dokaza, ali kada je trebalo prikupiti dokaze o lancu komandovanja, naišli smo na ogromne prepreke. Da su htjele, velike sile su mogle pomoći obavještajnim informacijama, ali se to nije desilo pa je vrlo kasno počela istraga protiv Miloševića.

– U knjizi detaljno govorim o dešavanjima u zadnjih 12 godina. Uvijek se govorilo da između Karadžića i Mladića i velikih sila postoji dogovor o nehapšenju. Pričalo se da je Ričard Holbruk (Richard Holbrooke) sklopio dil s Karadžićem a Francuzi s Mladićem. Te su priče najčešće dolazile od osoba koje su bliske njima dvojici i redovno su snažno demantirane iz glavnih gradova velikih sila. Tribunal nikada nije imao čvrsti dokaz koji bi potvrđivao postojanje dogovora. No, postojao on ili ne, činjenica je – i to se vidi u mojoj knjizi – da postoji vrlo jasan i sistematski neuspjeh u hapšenju ove dvojice zbog odbijanja velikih sila da se oni uhapse. Želim istaći još nešto. Ako je neko nekada možda i napravio neki dogovor s zločincima, on je prestao biti obavezujući onog momenta kada je osoba optužena za najteže ratne zločine. Besmisleno je – bilo dogovora ili ne – da se on poštuje i danas!
Gdje je Karadžić?
– Ne znam. Ali znam da je više puta jasno lociran i – nije uhapšen! U knjizi navodim, naprimjer, jedan događaj iz 1997. godine. Tada je NATO dobio mandat da hapsi optužene i počele su akcije. Nekih 30 ljudi prebačeno je u Hag na osnovu toga. No, to se ne odnosi na Karadžića i Mladića. Mladića su velike sile obavijestile o tome i od tada je u Srbiji. Karadžić ne želi biti diskretan, dostupan je novinarima, možete ga lako vidjeti kako obavlja svakodnevne aktivnosti, prolazi kroz kontrolne punktove NATO trupa u BiH bez problema… Novinari jasno ističu da – ako se želi – Karadžić lako može biti uhapšen. Suočeni s tom blamažom, predstavnici sila ga mole da bude diskretniji i krajem 1997. godine Rusi ga, na zahtjev i uz znanje velikih sila, prebacuju u Bjelorusiju gdje on ostaje nekoliko mjeseci, ali se vraća nazad u BiH. Tu postaje diskretniji i – ništa se ne dešava. Haški tribunal se onda nađe u situaciji da putem posrednika dobije ponudu Karadžića da se preda. To je bilo 1999. godine. Ispostavi se da je to neozbiljna ponuda jer on traži da se preda, a da mu se zauzvrat povuče optužnica. Tribunal nastoji, onda, ubijediti velike sile da se na sljedećem sastanku s njim on ili navede na predaju ili uhapsi. No, do tog sastanka nije došlo.

– To piše u knjizi!
Uloga Zapada
Ako je Milošević, kao čovjek koji je znao i mogao kompromitirati svijet zbog nečasne uloge u BiH, uhapšen i sudi mu se, zašto Karadžić nije. Što je to on opasniji od Miloševića? – Za razliku od Miloševića, koji je negirao svoje učešće u zločinima u Srebrenici, Karadžić je bio “na licu mjesta”. Argument koji je koristio Milošević koristile su i velike sile – oni su horski govorili da s time nemaju nikakve veze. Karadžić je bio najdirektnije umiješan – kao i Mladić – kroz naredbe koje je potpisivao i aktivnosti na terenu!
I Zapad je to znao?
– Pa imali su informacije, to je nesumnjivo. Oni ni sada ne žele dati podatke o tome.
Time postaju saučesnici u agresiji i zločinu?
– Pazite, ne želim reći da su velike sile činile zločine. Zločine su činili lokalni ljudi. No, Zapad je “dosje Balkan” tretirao dosta komotno. Dugo se raspravljalo da li intervenirati ili ne. Njegov pristup problemu odražavao se na nastavak zločina. Greške diplomatije plaćali su ljudi na Balkanu svojim životima.
Zapad je žrtvovao Srebrenicu za mir
– Vojna operacija u Srebrenici mogla se predvidjeti. Na proljeće 1995. godine Milošević je potpisao da prihvata ono što će se kasnije desiti u Dejtonu pod uvjetom da istočni dio BiH, uz Drinu, bude kompaktan teritorij. To mu je dato i on sa svojim štabom počinje pripremati vojnu operaciju. Dio tog štaba je i Mladić. Zapadne zemlje imale su uvid u aktivnosti. Amerikanci imaju baze u Hrvatskoj u kojima slušaju šta se priča između Beograda i ljudi na terenu i ništa ne preduzimaju. Šta više, oni negiraju da je cilj operacija osvajanje Srebrenice. No, kada se to desilo, ništa se ne čini. Beograd ništa ne poduzima mada se moglo pretpostaviti da će doći do zločina. Mladić je tome sklon i zna se kako se ponaša sa zarobljenicima. Umjesto toga, Zapad daje gorivo da se žene i djeca deportiraju a muškarci pobiju. U knjizi prenosim i razgovor Širaka (Chirac) i Klintona (Clinton) gdje se govori o zločinima, da se muškarci razdvajaju od žena i male djece. No, ništa se ne preduzima. U novembru u Dejtonu se već zna da je pobijeno oko 8.000 muškaraca iz Srebrenice. Umjesto da se Srebrenica oduzme Srbima, ona ostaje u njihovim rukama! Taj grijeh iz 1995. godine pokazuje dublje razloge zbog čega je cijela priča o istini o Srebrenici i ratu u BiH, uključujući hapšenje Karadžića i Mladića takva kakva jeste.
Odbijanje zahtjeva
– Tužilaštvo, ali i cijeli Tribunal, stalno je tražilo da mu se da pravo da sami hapsimo optužene. To nije samo bio zahtjev Del Ponte, već i njenih prethodnika. Govorili smo, ako je “Karadžića nemoguće naći”, dajte nam mandat i mi ćemo to uraditi. Nisu nam dopustili. Najveći kompromis koji smo uspjeli iznuditi jeste da nam se odobri formiranje tzv. timova za potragu. Oni u više navrata uspijevaju locirati Karadžića, te se informacije proslijede silama i – ne desi se ništa!
Unutarnje opstrukcije
– Dok su interesi međunarodne pravde i međunarodne politike isti, Tribunal dobro radi. Kada se sud “izmakne”, onda se stvaraju neke vrste ad hoc tijela koje ometaju njegove aktivnosti. To se radi na različite načine – unutarnjim opstrukcijama ljudih koji su infiltrirani negdje i oni čine sve da se određene stvari ne dese. Tih ljudi bilo je i u Tužilaštvu, nažalost, ali i u nekim diplomatskim misijama…
Akt licemjerja velikih sila
– Osnivanje Tribunala u Hagu bio je akt licemjerja. U to vrijeme – 1993. godine – svijet je bio suočen sa snažnim pritiskom javnosti zbog masovnih zločina u BiH. Velike sile nisu željele vojno intervenirati i neko je došao na ideju da se formira međunarodni sud. Tribunal je tada tako koncipiran – bez obzira na izjave koje su davane o pomoći žrtvama i kažnjavanju svakoga ko je počinio zločine – kao diplomatska prijetnja, a ne stvarni sud. U takvom kontekstu, Tribunal je zabilježio izuzetne uspjehe. Sjetit ćete se da 1993. godine niko nije znao kako će se finansirati taj sud. Sudije su došle praktično na ledinu, bez sredstava za rad. Velike sile su željele da on bude njihov instrument, a ne tijelo koje će po prvi put nakon Drugog svjetskog rata, provoditi usvojene međunarodne konvencije.
Budućnost ICC-ja
– Zahvaljujući upornosti ljudi u Tribunalu ponajviše, došlo je do formiranja stalnog Međunarodnog krivičnog suda (ICC). I taj sud se sada suočava sa pritiscima velikih sila, koje poručuju, naprimjer, da se optužnice za zločine u Darfuru stave u ladicu, kako ne bi smetale diplomatama u pronalaženju održivog rješenja.
